Terms of Service

These Terms of Service ("Terms") govern your access to and use of overnightcollision.com (the "Site") operated by Overnight Collision Center LLC ("Overnight Collision," "we," "us," or "our"). By using the Site or submitting a request through it, you agree to these Terms. If you do not agree, do not use the Site.

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit false, misleading, or fraudulent information
• Impersonate another person or vehicle owner
• Use the Site to send spam, malware, or any automated traffic that interferes with normal operation
• Attempt to gain unauthorized access to any part of the Site or its underlying systems
• Reproduce, scrape, or republish Site content for commercial purposes without our written permission

Any price range, repair time, or recommendation we provide based on a form submission or uploaded photos is a preliminary estimate only. It is not a binding quote or contract for repair. A final, written estimate is provided only after an in-person inspection of your vehicle at our shop, as required by Texas Occupations Code Chapter 2306. Actual repair costs may vary based on hidden damage, parts availability, supplemental insurance approvals, and the condition of the vehicle at intake.

Submitting an appointment request through the Site does not guarantee a confirmed appointment. We will contact you to confirm availability before reserving a service slot. We reserve the right to decline or reschedule requests at our discretion.

All actual repair work is governed by the written Repair Authorization you sign at the shop, not by these Terms. That authorization controls scope of work, parts selection (OEM/aftermarket/recycled), pricing, payment terms, storage fees, and warranty coverage.

Lifetime workmanship warranty. Our lifetime warranty on paint and body workmanship covers defects in our labor for as long as you own the vehicle, subject to the conditions set out in the written warranty provided at service completion. The warranty does not cover damage from subsequent collisions, neglect, environmental factors, or third-party repairs.

By uploading photos or other content through the Site, you represent that you own the content or have permission to share it, and you grant Overnight Collision a non-exclusive, royalty-free license to use the content solely to prepare your estimate, perform the requested repair, and keep records related to your job. We will not publish identifiable photos of your vehicle for marketing without your separate written consent.

The Site contains links to third-party websites (including Google Maps, telephone dialers, and email clients) for your convenience. We do not control and are not responsible for the content, accuracy, or privacy practices of any third-party site.

The Site, including its layout, text, graphics, logos, and photographs, is owned by Overnight Collision Center LLC or its licensors and is protected by U.S. and international copyright and trademark laws. You may view and print pages for your personal, non-commercial use. All other rights are reserved.

The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Information on the Site is intended as general information about our services and is not a substitute for an in-person inspection or professional advice.

To the fullest extent permitted by law, Overnight Collision Center LLC and its owners, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the Site, including loss of data, loss of profits, or vehicle downtime. Our total liability arising out of or relating to these Terms or your use of the Site will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.

You agree to indemnify and hold harmless Overnight Collision Center LLC from any claim, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any law, or your misuse of the Site.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Bexar County, Texas, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will revise the "Effective date" above. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
